These terms

This website is operated by DigiCoyote, a software development firm in Vancouver, British Columbia, Canada. Using digicoyote.com or any of the tools on it means you accept these terms. If you do not, please do not use the site.

These terms cover the website. They do not govern client work: an engagement with us runs under a separate written agreement, and where that agreement and these terms disagree, the agreement wins.

Nothing here is an offer or a quote

The content on this site - service descriptions, case studies, timelines, articles - is provided for information. It is not a contractual offer, not a price, and not professional advice you should act on without talking to us about your situation. Any figures shown in a case study describe that project and are not a prediction about yours.

We keep the site accurate and correct mistakes when we find them, but we do not warrant that everything on it is complete or current.

The developer tools

The tools are provided free, without accounts and without any guarantee. They are offered as is and as available, with no warranty of any kind - not of accuracy, not of uptime, not of fitness for a particular purpose. We may change, rate-limit or withdraw any of them at any time, without notice.

Data you put into a tool is deleted automatically when it expires, and may be deleted sooner if we need to. There are no backups of it and no way to recover it. Do not use the tools for production secrets, personal information, or anything you cannot afford to lose or to have seen by someone who guesses or is given the link.

Several tools send a request to a destination you choose. You are responsible for that request. Only point them at systems you own or have permission to test.

Acceptable use

When using this site, you agree not to:

• break any law, or infringe anyone’s rights;
• use the tools to probe, scan, attack, overload or gain unauthorised access to any system you do not have permission to test;
• store or transmit malware, phishing content, or material that is unlawful, defamatory or harassing;
• use the URL shortener or webhook tools to disguise the destination of a link used to deceive people;
• attempt to defeat rate limits, or automate the tools at a volume that degrades them for other people;
• scrape or resell the site or its tools as a service of your own.

Suspension

We may block access, delete content, or withdraw a tool where we reasonably believe these terms are being broken or the service is being abused. Where abuse is affecting other users we will act first and explain afterwards if asked.

Ownership

The site - its text, design, logo, brand and code - belongs to DigiCoyote and is protected by copyright and trade-mark law. You may read it, quote it with attribution, and link to it. You may not republish it as your own or use our name or logo to imply a relationship that does not exist.

Content you put into a tool stays yours. You give us only the permission needed to operate the tool - to store your input, process it, and show it back to you or to whoever holds the link - and nothing more. We do not use it to train anything and we do not sell it.

Third-party names on this site belong to their owners, and appear only to describe technologies we work with.

Links out

Where we link to another site, or a tool fetches one, we are not responsible for what is there. A link is not an endorsement.

Liability

To the fullest extent the law allows, DigiCoyote is not liable for indirect, incidental or consequential loss arising from your use of this site or its tools, including lost profit, lost data or business interruption. Our total liability for any claim connected with the free use of this website is limited to CAD $100.

Nothing here limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be limited. If you are a consumer, this clause does not take away rights the law gives you.

This limit applies to the website only. Liability for client work is set out in the agreement for that engagement.

Privacy

What we collect and why is set out in the privacy policy, which forms part of these terms.

Governing law

These terms are governed by the laws of British Columbia and the federal laws of Canada that apply there. The courts of British Columbia have exclusive jurisdiction, except that either of us may seek an injunction wherever it is needed.

Changes

We may update these terms. The date at the top of the page shows when they last changed, and continuing to use the site after a change means you accept it.
